MICHIGAN MISDEMEANOR CHARGES

If the maximum penalty for a charged offense is incarceration in jail for one year or less, the charge is a misdemeanor. Misdemeanor offenses can be charged under state law or municipal ordinance.

A misdemeanor conviction can result in jail time and, in certain cases, a substantial amount of jail time. Probationary terms can be extremely onerous. Additionally, having a criminal conviction can have serious long-term consequences on a person's employment. Fortunately, many punishments available to a judge are discretionary. An experienced attorney may be able to convince a judge to utilize their discretion in sentencing a client to avoid jail and/or harsh probationary terms. The facts in each case are as different as the personal situations of each client. In some cases the evidence is so weak that the case merits a jury trial. Diversion programs, delayed sentencing, and plea agreements are some of the ways in which a bad situation can be made workable. The ability to find a proper resolution requires an understanding of the client's needs as well as the ability to persuade the court and the prosecutor to fashion a resolution that allows the client to continue on with minimal disruption to their life.
