MISDEMEANOR CHARGES

Any crime punishable by a maximum jail term of one year or less is considered a misdemeanor criminal offense under Michigan state law. The only exceptions to this rule are "High-Crime Misdemeanors" such as the crime of "Resisting & Obstructing a Police Officer" which carries a penalty of up to 2 years of incarceration. However, the vast majority of Michigan misdemeanor criminal offenses come in two forms: misdemeanors punishable by up to 93 days in jail and misdemeanors punishable by up to one year in jail.

Misdemeanor crimes punishable by up to 93 days in jail can be charged under local city/municipal ordinance or state law. If you are charged under a local city ordinance, the charge is prosecuted by the city attorney representing the locality in which the crime is alleged to have occurred. If you are charged with a 93 day misdemeanor under Michigan state law, the prosecuting attorney will be the county prosecutor for the county in which the crime is alleged to have occurred.

Misdemeanors punishable by up to one year in jail are handled exclusively by the county prosecutor. Michigan law does not authorize city attorneys to prosecute misdemeanors punishable by more than 93 days in jail.
